Respondent(s)Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent to register, release and handover the Assignment Agreement dated 24.12.2024 executed between the Petitioner and Centrum Housing 1/10 https://www.mhc.tn.gov.in/judis W.P.No.19914 of 2025Finance Limited, bearing No.P/Tiruvallur Joint 1/529/2024 within a time -frame to be fixed by this Hon'ble Court.For Petitioner(s) : Ms.B.SharmilaFor Respondent(s) : Ms.Bakkiyalakshmi for R1 & R2 Government AdvocateORDERBy consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 2nd respondent to register, release and handover the Assignment Agreement dated 24.12.2024 executed between petitioner company and Centrum Housing Finance Limited, bearing No.P/Tiruvallur Joint 1/529/2024 within a time frame to be fixed by this Court.3.Petitioner herein, Edelweiss Asset Reconstruction Company Limited, is a company registered under the companies Act, 1956 (hereinafter referred to as “Assignee”) and registered as an Asset Reconstruction Company in terms of Section 3 of SARFAESI Act, 2002. 2/10 https://www.mhc.tn.gov.in/judis W.P.No.19914 of 2025Petitioner is acting in its capacity as trustee of EARC Trust – SC 493 for the benefit of the holders of security receipts issued by the trustee thereunder. 4.Centrum Housing Finance Limited, a public limited company registered under the companies Act, 2013, (hereinafter referred to as the “Assignor”), is engaged in the business of extending finance facilities to its customers upon execution of financing documents. 5.The Assignor approached the Assignee and expressed its willingness to assign certain loans which were disbursed under financial facilities along with all its rights, title and interest in the financing documents along with underlying security interests, pledges and/or guarantees in respect of such loans, to and in favour of the Assignee, pursuant to the terms and subject to the conditions as envisaged under Section 5(1)(b) of SARFAESI Act.6.The Assignment Agreement was executed between the Assignee and Assignor on 24.12.2024 with an intention to assign certain debts along with underlying securities in favour of Assignee and submitted the 3/10 https://www.mhc.tn.gov.in/judis W.P.No.19914 of 2025above agreement before the Sub Registrar of Tiruvallur Joint 1 on 24.12.2024, for registration. 7.It is submitted that the Assignment Agreement dated 24.12.2024 has been kept pending since then.
