Mr.Vijayan Subramanian in both O.AsC O M M ON O R D E RHeard the learned counsel for the applicant/plaintiff. An ad interim is sought in the nature of 'John Deo' order.2. The suit has been filed as a Quia timet action. The applicant / plaintiff is a Cinema Producer. One such film produced by them is 'KAPKAPIII'. The CBFC certificate for the said film also confirms that the applicant/plaintiff is the producer. The defendants 1 to 19 are Internet Service Providers and the defendants 20 to 26 are Cable TV Operators. Adequate averments have been made in the plaint as well as in the affidavit filed in support of these applications that the applicant/plaintiff will be put to irreparable loss and hardship if the film 'KAPKAPIII' is broadcasted illegally by the respondents 1 to 20 in O.A.No.523 of 2024/defendants 1 to 20 and respondents 1 to 6 in O.A.No.524 of 2024/defendants 21 to 26. The film 'KAPKAPIII' is scheduled to be released on '23.05.2025'. 4. This Court is satisfied with the averments contained in the plaint as well as the affidavit filed in support of these applications. If the defendants illegally broadcast the film 'KAPKAPIII' without the permission of the applicant/plaintiff, the applicant/plaintiff will be put to irreparable loss. If the defendants and the websites disclosed in the schedule are allowed to illegally broadcast the film 'KAPKAPIII' without the consent of the applicant/plaintiff, certainly, the applicant/plaintiff will be put to irreparable loss and hardship.5. Since a prima facie case has been made out by the applicant/plaintiff and the balance of convenience and irreparable hardship have also been established by the applicant/plaintiff, this Court is inclined to grant interim injunction as prayed for in these applications. 6. Accordingly, there shall be an order of interim injunction as prayed for in these applications. Notice to the respondents 1 to 20 in O.A.No.523 of 2024/defendants 1 to 20 and respondents 1 to 6 in O.A.No.524 of 2024/defendants 21 to 26 returnable by 23.06.2025. Private notice is also permitted.
