The application in A.No.3598 of 2025 has been filed by recommending the following persons viz., (1) Dr.S.S.Murugan (Ph.D) alias Siva Subramanian Murugan as a Trustee of Vasudeva Pillai Trust, Situated at No.23, Thandavan Street, Purusavakkam, Chennai 600 007, for a period of three years from the date of his appointment.7. The application in A.No.3910 of 2025 has been filed by recommending the following persons viz., (1) Dr.N.Kalyanaraman, Son of K.R.Narasimhanas a trustee of Vasudeva Pillai Trust at No.23, Thandavan Street, Purasawakkam, Chennai 600 007 for a period of three years from the date of his appointment.10 https://www.mhc.tn.gov.in/judis A No. 2753 of 20258. The Trustees to the subject Trust have to be appointed as per the terms of the Scheme Decree passed on 16.02.1931 in C.S. No. 246 of 1930.9. Some of the conditions to be complied for the appointment of trusteeship has been stated in the scheme as under:V. No one shall be appointed as a Trustee (1) who is not a member of the Karuneegar caste, (2) who is not a Hindu, (3) who is under 25 years, (4) who is an undischarged insolvent, (5) who is a lunatic or suffering from such incurable disease as unfits him for work, (6) who has been convicted of an offence involving moral turpitude, (7) who is not employed at Madras or who does not reside either at Madras or at a place within 20 miles of it. 10. Clause XV of the terms of the Scheme Decree stipulates the procedure to be followed for filling up of the vacancies and the Clause XV of the Scheme Decree is extracted hereunder:-“In the event of vacancy or vacancies arising in the office of the Trustees for any reason whatsoever, the Court shall appoint other Trustees on the application of any one of the remaining trustees or on the application of the retiring Trustees or the Secretary for the time being of the Chennai Magana Karuneega Sangam or any two members of the Karuneega Caste. Notice shall be to the Chennai Magana Karuneega Sangam, if that body is in existence and its wishes considered. Each Trustees shall hold office for three years from the date of his 11 https://www.mhc.tn.gov.in/judis A No. 2753 of 2025appointment. And the said advocate for the defendants 1 and 2 herein representing to the Court that he has no instructions to opposite the appointment of the following parts as the first act of trustees to be appointed under the aforesaid scheme, IT IS FURTHER ORDERED as follows: ”11. As per Clause XV of the scheme decree, whenever any application has been filed from the eligible persons or through persons who are eligible to propose certain persons for appointment of trustees, the Court has to first verify whether they fulfil the qualification criteria as shown under Clause V of the scheme. Now, the merits of the persons proposed or applied have to be tested in accordance with their qualification and in the light of the views offered by the first respondent Sangam. 12. The Court is not compelled and it is not mandatory for the Court to consider only the wishes and the recommendations of the Sangam for deciding the persons who can be appointed as trustees. Whatever may be the case, the Court has to first convince itself about the eligibility of the applicants and there cannot be any compromise on that. With regard to the eligibility criteria, even if the Sangam wishes to relax the eligibility, the Court is not obliged to consider the same. 12 https://www.mhc.tn.gov.in/judis A No. 2753 of 202513. The wishes or the opinion of the Sangam with regard to other aspects can be rejected only if they are unreasonable or made with any ulterior motive. Ultimately, Madambakkam Vasudeva Pillai Trust has been founded for the benefit of Karuneegar Community especially to give scholarship to the deserving poor boys and girls of Karuneegar Community and in order to encourage them to proceed with the further studies. 14. On notice, Chennai Magana Karuneegar Sangam has given its comments against each of the candidates who are either applied or recommended for appointment of trustees. So, I feel the merits of the applicants can be considered on the basis of the materials produced by the applicants and the comments of the Sangam. A.No.2753 of 202515. The applicant has filed this application by recommending the following persons viz., Mr.T.Chakravarthi, Mr.N.Manoharan, Mr.T.Duvarakanathan, Mr.S.Mayil Vaganan, Ms.S.Manmathadevi as Trustees of Madambakkam Vasudeva Pillai Trust. The Sangam has stated that there is no verifiable information available for these candidates with regard to their eligibility criteria or other merits. In view of the other findings already rendered in the order dated 04.02.2022 in A.No.4398 of 2021, this application cannot be considered favourably. 13 https://www.mhc.tn.gov.in/judis A No. 2753 of 2025A.Nos.2754 & 2755 of 202516. As regards the recommendees in A.Nos.2754 & 2755 of 2025, the Sangam has stated that there is no possibility to make the eligibility assessment due to lack of eligibility particulars. Hence, the Applications in A.Nos.2754 & 2755 of 2025 cannot be considered favourably. A.No.2756 of 202517. So far as the recommendees in A.No.2756 of 2025 are concerned, the Sangam has stated that both G.Naresh Kumar and T.Ganesan are Engineering Graduates and they produced certificate to show that they belonged to Karuneegar Community. There is no adverse remarks against both of them. However, no materials have been produced to show their social contribution, though it is stated in the respective biodata of the candidates that they are supporting some poor students for their educational purposes. Among the two, G.Naresh Kumar is a builder and T.Ganesan is supporting a child through World Vision and Goodness Foundation. From the biodata of T.Ganesan, it appears that he is more suitable and he he has got more experience and world exposure. Karuneegar Sangam has also given good opinion about G.Naresh Kumar. So, I feel both T.Ganesan and G.Naresh Kumar can be appointed as Trustees. A.No.3540 of 202518. So far as the application in A.No.3540 of 2025 is concerned, the recommendee Mrs.Sridevi has got good educational qualification. She is said to 14 https://www.mhc.tn.gov.in/judis A No. 2753 of 2025be a distinguished educationalist, social worker and poet. There are supporting materials available to substantiate the same. To show that Mrs.Sridevi belongs to Karuneegar Community, necessary certificate is produced. As she is a writer, poet and involved in lot of social service, I feel she can be considered to be a fit person to be appointed as one of the trustees. A.No.3598 of 202519. So far as the application in A.No.3598 of 2025 is concerned, the applicants of this application have recommended one Dr.S.S.Murugan who is a Scientist in toxicology and Regulator compliance Specialist. It is stated that he has distinguished service across public health, scientific policy-making, quality assurance and regulatory capacity-building and he has performed leadership roles in public trusts, statutory bodies and institutional advisory committees. Hence, I feel he can also be considered as a fit person to be appointed as one of the trustees. 20. So far as the application is A.No.3910 of 2025 is concerned, the recommendee viz., Dr.N.Kalyanaraman appears to be having teaching experience. Hence, his service is mainly concerned with the educational institutions and against whom, there is no adverse remarks given by the Chennai Karuneegar Sangam also. Hence, I feel he can also be considered as a fit person to be appointed as one of the trustees.15 https://www.mhc.tn.gov.in/judis A No. 2753 of 202521. In the result, the applications in A.Nos.2756, 3540, 3598 & 3910 of 2025 are allowed and the applications in A.Nos.2753, 2754, 2755 of 2025 are dismissed. Accordingly, Mr.T.Ganesan, Mr.G.Naresh Kumar, Mrs.Sridevi, Dr.S.S.Murugan, Dr.N.Kalyanaraman are appointed as trustees of the Trust and they shall discharge their function as trustees in accordance with the scheme decree, without giving room for any complaints and work to fulfil the objectives of the Trust for a period of three years or until the next trustees are appointed.
