Heard the learned counsel appearing on either side and perused the materials available on recordPage 2 of 10 https://www.mhc.tn.gov.in/judis W.P.No.13208 of 20253. The petitioner, after completing her 12th Standard, appeared for NEET-UG 2024 and scored 81.86% marks. Thereafter, the petitioner submitted an application seeking admission to the MBBS course under NRI quota, as her maternal uncle, a Non-Resident Indian residing in Mauritius, had agreed to sponsor her education. Accordingly, the petitioner submitted the said application through one Srinivasan of Srinivasan Coaching Centre, Porur. At the time of submission, all the requisite documents including the NRI certificate issued by the High Commission of India, Mauritius-Port Louis were duly uploaded. Subsequently, the petitioner was called for counselling by the third respondent and was given provisionally allotted a seat under NRI quota in the fourth respondent college for the MBBS Course. She also paid the requisite fees and joined the said college. 4. At the time of joining, the petitioner produced all the original documents, which had already been uploaded along with her application. On verification of all those documents, the petitioner was admitted to the MBBS course. While being so, in the month of March 2025, the fourth respondent informed the petitioner that her admission Page 3 of 10 https://www.mhc.tn.gov.in/judis W.P.No.13208 of 2025was liable to be cancelled by the third respondent and consequently, she was not allowed to attend the classes on the ground that the documents uploaded along with her application were found to be forged.5. The learned counsel appearing for the petitioner submitted that the petitioner had not uploaded the documents referred to by the third respondent while cancelling the allotment of the seat under the NRI quota. Those documents were not produced by the petitioner. The only mistake committed by the petitioner was that she approached a person from a coaching centre for assistance in submitting the application. While submitting the application, those documents were not even produced by the petitioner at the time of admission in the fourth respondent college. She had produced all the original documents, which were also found to be genuine one.6. On instructions, Mrs.M.Sneha, learned Special Counsel for the respondents 1 to 3, submitted that while applying for counselling, the petitioner uploaded certain documents under NRI quota along with the certificate issued by the High Commission of India at Singapore and Page 4 of 10 https://www.mhc.tn.gov.in/judis W.P.No.13208 of 2025relationship certificate in the name of one Subramani Raghupathi, describing him as the petitioner's paternal cousin. The petitioner has also uploaded the relationship certificate allegedly issued by the Tahsildar, Mettur, Salem District. On verification of all the documents, they were found to be forged and as such, the admission of the petitioner was cancelled to the MBBS Course under NRI quota. She also produced the original application of the petitioner along with the documents, which were uploaded. The petitioner completely denied those documents, which were produced before this Court. The said Subramani Raghupathi is complete stranger to the petitioner and there is a chance that the documents were wrongly uploaded by the person who assisted the petitioner in submitting her application for admission. Further, she vehemently contended that there was absolutely no necessity for the petitioner to upload those fabricated documents, when she had already obtained the relationship, embassy certificate and NRI certificate even prior to the date of application. It is further submitted that all the documents which were produced before the fourth respondent were verified and found to be genuine.Page 5 of 10 https://www.mhc.tn.gov.in/judis W.P.No.13208 of 20257. A perusal of the relationship certificate produced before the fourth respondent reveals that the sponsor on behalf of the petitioner is her maternal uncle of the petitioner The relationship certificate also verified and found to be genuine. Further, the NRI certificate issued by the Assistant Consular Officer, High Commission of India, Mauritius dated 08.07.2024 certifies that the sponsor Venkatesh Sevigounder, holder of India Passport residing in Mauritius since 14.07.2023 and he is Non-Resident Indian (NRI).8. Further, the learned counsel for the third respondent produced the documents, which were allegedly uploaded by the petitioner along with her application for admission to the MBBS Course. It is denied by the petitioner and there is no proof to show that the petitioner uploaded those documents along with the application. That apart, the original documents produced before the third respondent at the time of her application were verified and found to be genuine. It is also stated that the petitioner has now completed first year MBBS Course in the fourth respondent college. Page 6 of 10 https://www.mhc.tn.gov.in/judis W.P.No.13208 of 20259. It is also pertinent to note that the quota under the Non-Resident Indian itself is questionable one. Since in order to get admission under NRI quota, those who are capable to pay fees, they used to such for Non-Resident Indian and obtained relationship certificate. In the case on hand, the person who sponsored for the petitioner is none other than the maternal uncle, i.e., petitioner's mother's own brother. The statements of bank account and passport of the sponsor/NRI were also produced at the time of admission. When the petitioner is completely denying the uploaded documents, which were now to be fake and when there is no proof to show that the petitioner only uploaded those documents, her candidature cannot be cancelled on the ground that the petitioner produced fake documents. That apart, at the time of her admission, she produced all the genuine certificates as required in the prospectus under the NRI quota. It is not the case of the third and fourth respondents that the petitioner failed to pay the requisite fees. On the contrary, the fees were paid through the NRI sponsor and the same was duly received by the third and fourth respondents.Page 7 of 10 https://www.mhc.tn.gov.in/judis W.P.No.13208 of 202510. In view of the peculiar circumstances of the case and also considering the future of the petitioner, this Court is inclined to interfere with the impugned order passed by the third respondent. Accordingly, the order dated 25.03.2025 passed in Ref.No.231/CSI(1)/2024 by the third respondent is hereby quashed. The fourth respondent is directed to permit the petitioner to continue her candidature in the MBBS Course under NRI quota.11. In the result, this Writ Petition stands allowed.
