After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: https://www.mhc.tn.gov.in/judis 2TERMS OF SETTLEMENTThe Tribunal has awarded a sum of Rs.20,07,800/- Lakhs [Rupees Twenty Lakhs Seven Thousand and Eight Hundred only], together with interest at 7.5% per annum, from the date of petition till the date of deposit (excluding the period of dismissal for default, if any). Aggrieved by the award of the Tribunal, the appellant/ claimant preferred the present appeal.

After due deliberation and consultation, both the parties have agreed to settle to a sum of Rs.8.00 lakhs with interest at the rate of 7.5% (Rupees Eight Lakhs only) over and above the amount awarded by the Tribunal, as full quit compensation, inclusive of the interest and cost.

Hence, the second respondent/ insurance company is directed to deposit the enhanced amount of Rs.8.00 Lakhs with interest at the rate of 7.5% (Rupees Eight Lakhs only), arrived today, less the amount already deposited if any, within a period of six weeks from the date of receipt of a copy of this order, to the credit of M.C.O.P.4975 of 2018 on the file of the Motor Accident Claims Tribunal, III, Court of Small Causes, Chennai) and on such deposit, the appellant/ claimant is directed to withdraw the same.

The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
