Out of the wedlock, a girl child was born to them. Due to some misunderstandings between them, they started living separately since 23.11.2010. Thereafter, on 23.01.2013, the petitioner had filed divorce petition in H.M.O.P.No.17 of 2013 against the first respondent/wife before the learned Sub Court, Pollachi. Aggrieved by the same, the petitioner preferred an appeal in C.A.No.217 of 2017 on the file of the learned III Additional District Sessions Judge, Coimbatore. Meanwhile, the first respondent also filed a suit in O.S.No.185 of 2016 before the Subordinate Judge, Pollachi against the petitioner, seeking interim maintenance of Rs.20,000/- per month from the date of suit.6. After full fledge trial, the trial Court decreed the suit vide order dated 11.08.2025 and ordered to pay a sum of Rs.20,000/- as monthly maintenance in favour of the first respondent herein.7. Though the learned counsel for the petitioner submitted that the petitioner has challenged the order passed in D.V.No.9 of 2013 and also the appellate Court order dated 04.03.2020, now the petitioner is ready and willing to pay a monthly maintenance of Rs.20,000/- as ordered in O.S.No.185 of 2016 dated 11.08.2025 on the file of Subordinate Judge, Pollachi.8.
The learned counsel for the petitioner further submitted that so far the rent for the premise in which the first respondent is residing, the petitioner is ready and willing to pay Rs.5,000/- per month.8 https://www.mhc.tn.gov.in/judis CRL RC No. 341 of 20219. In view of the order passed in O.S.No.185 of 2016 on the file of the learned Subordinate Judge, Pollachi and also taking into consideration the submission made by the learned counsel for the petitioner, this Court issues the following directions: (i)The order dated 04.03.2017 passed by the Appellate Court in C.A.No.217 of 2017 on the file of the learned III Additional District Sessions Judge, Coimbatore is partly confirmed. (ii) Insofar as the directions Nos.1, 3, 4, 5, 6, 8 and 9 issued in C.A.No.217 of 2017 dated 04.03.2020 are hereby confirmed. (iii) Insofar as the direction No.2 in C.A.No.217 of 2017 dated 04.03.2020 is concerned, it is modified to the tune of Rs.5,000/- as awarded by the trial Court.
