For Petitioner: Mr.G.Sankaran, Senior Counsel Mr.S.Bharathi RajanFor Respondent : Mr.D.Ravichander, Standing CounselO R D E RThis writ petition has been filed challenging the order passed by the respondent dated 28.02.2025 thereby refused to grant continuous affiliation to the petitioner institution for conducting B.Ed. course. 2.The petitioner has been granted with affiliation by the respondent and the same was periodically extended for every three years to conduct B.Ed. programme of two years duration with annual intake of 100 students for two basic units from the academic year 2015-16. The last time, the petitioner was granted affiliation was for the academic years 2021-2022 to 2023-2024 by the proceedings dated 02.12.2021. After which, the petitioner was permitted to apply for continuation of provisional affiliation for the next three academic years i.e. 2024-2025 to 2026-2027 in the prescribed format on or before 31.10.2023. 2/8 https://www.mhc.tn.gov.in/judis W.P.No.9058 of 2025Accordingly, the petitioner applied for the same on payment of prescribed fees on 26.10.2023. On receipt of the said application, the respondent conducted inspection on 09.03.2024 and directed the petitioner to produce certain documents by the communication dated 23.04.2024. The petitioner submitted scanned copies of all those documents through mail on 07.05.2024. Thereafter, the petitioner uploaded students' details and payment details of fees paid by the students who have been admitted and stated that the classes commenced from 23.10.2024. It was also duly communicated to the respondent. However, the petitioner was not found in the official website of the respondent university for uploading the details of the students admitted in the academic year 2024-2025. By the communication dated 20.11.2024, the respondent informed the petitioner that inspection committee visited the petitioner institution and submitted report and that the petitioner has not complied with NCTE norms and as such, syndicate has not permitted for continuation of provisional affiliation. It was challenged before this Court in WP.No.38095 of 2024 and it was dismissed. In the writ appeal, the Division Bench in WA.No.161 of 2025 by order dated 31.01.2025 directed the respondent to re-consider the matter in the light of the documents placed for 3/8 https://www.mhc.tn.gov.in/judis W.P.No.9058 of 2025consideration. Thereafter, the petitioner submitted all the documents and the petitioner was called for enquiry and submitted the claim for grant of continuation of provisional affiliation. Thereafter, the respondent directed the petitioner to make payment of examination fee. The petitioner also filed writ petition before this Court in WP.No.8127 of 2025 for direction to the respondent to grant continuous affiliation to the petitioner for conducting B.Ed. course for the academic year 2024-2025, 2025-2026 & 2026-2027 and open portal for uploading the students details. However, the request made by the petitioner was rejected and the order was produced before this Court. Now once again, the respondent by an order dated 28.02.2025 denied the request made by the petitioner on the ground that the petitioner failed to submit nine documents. 3.The learned Senior Counsel appearing for the petitioner submitted that the respondent kept the application pending for long time and it was rejected only in the month of November 2024. As per the by-laws, the respondent ought to have considered the application before the month of June. In view of the interim order passed by this Court, the petitioner was permitted to admit students for the academic year 2024-4/8 https://www.mhc.tn.gov.in/judis W.P.No.9058 of 20252025. 4.The learned Standing Counsel appearing for the respondent would submit that as per the rules, affiliation cannot be granted with retrospective effect since the petitioner submitted all the required documents in the month of June 2025. 5.Heard, the learned counsel appearing on either side and perused all the materials placed before this Court.6.The petitioner admitted students for the academic year 2024-2025 in the month of June 2024. However, the respondent passed order for continuation of provisional affiliation only on 20.11.2024. Though the petitioner submitted the application for continuation of provisional affiliation well within the time, the respondent failed to pass any order immediately at least before the month of June 2024. Further, under Section 17(3) of National Council for Teacher Education Act, 1993, the order impugned in this writ petition would take effect for the next academic year 2025-2026 and 2026-2027. Therefore, this Court by 5/8 https://www.mhc.tn.gov.in/judis W.P.No.9058 of 2025order dated 14.03.2025, directed the respondent to open the online portal so as to enable the petitioner to upload the documents of the admitted students and also for remitting the examination fees including the theory and practical examination for the academic year 2024-2025. Accordingly, online portal was opened for the petitioner and the petitioner also uploaded the admitted students list on payment of fees. Now the entire documents as required by the respondent have been submitted.7.In view of the above, the impugned order dated 28.02.2025 passed by the respondent is quashed and the matter is remanded back to the respondent for fresh consideration and to pass orders for considering the documents produced by the petitioner by way of representation dated 23.06.2025 annexing all the documents which were already required by the respondent, on payment of requisite affiliation fees as well as inspection fees as required under the National Council for Teacher Education Act, within a period of four weeks from the date of receipt of copy of this order. 8.With the above direction, this writ petition stands allowed. 6/8 https://www.mhc.tn.gov.in/judis W.P.No.9058 of 2025Consequently, connected miscellaneous petitions are closed.
