This Writ Petition is filed praying for issuance of Writ of Certiorarified Mandamus to call for the records of the 3rd respondent dated 21.02.2022 passed in Rc.No786/2022/B2/CBE and quash the same as non-est in law and directing the 4th respondent to register the documents pertaining to the Survey Numbers 269/2A, 269/2B, 270, 271/1A, 271/1B, 271/1D, 272 PART without requirement of any consent of the 3rd respondent.3. At the outset, Mr.Avinash Wadwani, learned Standing Counsel appearing for the 3rd respondent / Wakf Board would submit that by proceedings dated 21.02.2022, an intimation was given by the 3rd respondent/Wakf Board to the Registering Authorities not to register certain properties, which according to it, constitutes Wakf Board properties, thereby attracting Section 22 A (1)(iv) of the Registration Act. It is also submitted by Mr.Avinash Wadwani that the writ petitions are premature, inasmuch as no Sale Deed has even been represented by any of the 76 petitioners. 4. There is merit in the submissions made by the learned Standing Counsel appearing for the 3rd respondent/Wakf Board.5. In view of the above , I do not see any reason to entertain the present https://www.mhc.tn.gov.in/judis WP No. 22216 of 2025writ petition at this stage. Hence, this Writ Petition stands closed. It is open to the petitioner to represent the documents/sale deed for registration before the appropriate respondent. The concerned respondent shall consider and register the same, if it is, otherwise in order. If for any reason, the registering authority finds that the registration ought to be refused, the same shall be done after assigning reasons.
