S.For Intervenor:Mr.Arun AnbumaniFor Respondent(s):Mr.S.UdayakumarGovernment Advocate (Crl.Side)CRL OP No. 15898 of 2025For Petitioner: Mr.P.Ram KumarFor Intervenor:Mr.Arun AnbumaniFor Respondent(s):Mr.S.UdayakumarGovernment Advocate (Crl.Side) https://www.mhc.tn.gov.in/judis CRL OP Nos. 6833, 15255 & 15898 of 2025COMMON ORDER The petitioners, who apprehend arrest for the alleged offence under Sections 408, 420, 477A, 109, 120B of IPC 1860, in Cr.No.34 of 2025 on the file of the respondent police, seek anticipatory bail.2.The allegation against the petitioners is that the petitioner in Crl.OP No.15255 of 2025 is ranked as A4, 4th petitioner in Crl OP No.6833 of 2025 is ranked as A6 and the petitioner in Crl OP No.15898 of 2025 is ranked as A7. The case of the prosecution is that the defacto complainant was running a Dina Color Lab and New Color India Films. They used to sell the various kinds of Camera and also doing a lab work and digital printing work etc. A1 to A4 have worked under various capacities in the Lab. Further, it is stated that A1 was involved in buying and selling Cameras on wholesale basis and supplied to various branches. It was assisted by A2 and A3 for the purpose of sale, accounting, purchasing and sale etc. They colluded and started to sell the various Cameras from the shop at under-rated prices to some other accused companies and collected money from them. Similarly, they had also involved in https://www.mhc.tn.gov.in/judis CRL OP Nos. 6833, 15255 & 15898 of 2025diverting the funds by using their own personal Gpay and other Mobile App and to the accounts of their family members including A6 who is the wife of A1 and A7 who is the wife of A2. It has been audited and found that to the extent of Rs.20 Crores have been misappropriated.3.The learned counsel for the petitioner for A6 submits that she is the wife of A1 and she is an uneducated and her account was fully operated by her husband and she was not aware about the banking transactions made by her husband and though it is stated that huge amounts have been transacted, she was not personally benefited from the money and further submitted that she had already appeared several times before the Investigating Officer for the purpose of investigation and further submitted that she is ready to co-operate with the investigation and prays to grant anticipatory bail to the petitioner/A6.4.The learned counsel for the petitioner for A7 has also placed the similar arguments that she is the wife of A2 and her bank account was also operated by her husband/A2 and she was not having any personal knowledge about the banking transactions that were taken place and she is being a lady, the learned https://www.mhc.tn.gov.in/judis CRL OP Nos. 6833, 15255 & 15898 of 2025counsel for grant of anticipatory bail to the petitioner/A7.5. The learned counsel for the petitioner/A4 submitted that she is only the in-charge of accounts and bills and she has been working as per the instructions of A1 to A3 and she was not benefited of any amount that was said to have been misappropriated and further submitted that she had also appeared several times before the Investigating Officer on the summons issued under Section 35 (A) of the BNS Act and she is also ready to co-operate with the investigation, hence, the learned counsel prays for grant of anticipatory bail to the petitioner/A4.6.The learned counsel for the Intervenor submitted that though it is stated that the petitioners herein are ladies and they have not having direct knowledge about the transactions, A6 and A7 though stated that they are the wives of A1 and A2 respectively, huge amount to the extent of Rs.2.45 Crores and Rs.4.2 Crores have been transacted through their accounts. Further, A1 and A2 were arrested and they have also categorically stated that the entire money were transacted through the petitioners' accounts and subsequently the money was once again transferred from these petitioners' account to other accounts and so https://www.mhc.tn.gov.in/judis CRL OP Nos. 6833, 15255 & 15898 of 2025far no money is recovered. He further submitted that as far as A4 is concerned she is also benefited from the accounts transacted and the statements were recorded from the arrested accused and so far no money is recovered and if the petitioners are granted anticipatory bail, there is a likelihood of hampering the investigation and there is no possibility of recovering the money. Hence, he opposed for grant of anticipatory bail to the petitioners.5.The learned Government Advocate (Crl.side) for the respondent/ police reported that totally 12 accused are involved in this case and A1 to A4 are the main accused and they have directly involved in fabrication of records, falsification of accounts, and misappropriation of funds. Further, he submitted that huge amount to the extent of nearly Rs.9 Crores are with these petitioners and so far no amount is recovered even though they were able to arrest A1 to A3 and only 65 sovereigns of gold and also some of the cars alone have been recovered and the investigation is pending in this case.
