The petitioner herein, who was arrayed as 6th respondent in the said interim application has come by way of this civil revision petition.2. The learned counsel for the petitioner would contend that the petitioner was not arrayed as party before the Trial Court and the plaint filed by the respondents 1 to 6 was rejected by the Trial Court and the same was challenged by them by filing an appeal before the first appellate court. In the said appeal, the petitioner has been impleaded as one of the parties/respondent and the interim order has been obtained against the petitioner.3. A perusal of the typed set of papers would indicate that interim injunction, not to alienate the suit property was granted only till 30.10.2023, while issuing notice to the respondents. The petitioner, immediately after receipt of notice, is expected to appear before the very same court and seek to vacate the interim order by filing appropriate application. Instead of filing such application before the first appellate court, the petitioner is not entitled to rush 9 of Page 11 https://www.mhc.tn.gov.in/judis CRP No.857 of 2024to this court seeking to set aside the impugned order. Since the petitioner has an alternative remedy, this court is not inclined to exercise its supervisory jurisdiction, as per the law laid down by the Hon'be Apex Court in the case of Virudhunagar Nadargal Dharma Paripalana Shabha Vs Tuticorin Educational Society reported in MANU/SC/1365/2019.4. Accordingly, this civil revision petition is dismissed with liberty to the petitioner to file petition to vacate injunction before the court concerned. If the petitioner filed vacate petition, the same shall be considered and disposed of by the first appellate court as expeditiously as possible in terms of Order 39 Rule 3-A of CPC. There shall be no order as to costs.
