The petitioner is an Engineering Graduate in Electronics and Communication of the year 2017 from Anna university. She belongs to MBC (DNC) category. The Tamil Nadu Uniformed Service Recruitment Board [TNUSRB] invited applications from the eligible candidates as per the Notification dated 05.05.2023 for Joint Recruitment of Sub Inspectors of Police (Taluk, AR & TSP) and Station Officers, Fire & Rescue Services Department 2023 from open market as well as from the departmental candidates. As per the notification, a total number of 615 vacancies have been earmarked for direct recruitment, for departmental candidates 20% i.e., 123 and remaining 80% for open candidates, in which 10% vacancies are earmarked for Wards quota and Sports quota. Out of 10% open quota, 9% for Wards of police personnel and 1% for ministerial staffs. As the petitioner’s father, namely, Karthigairaj had served as Record Clerk in the office of the Superintendent of Police, Ramanathapuram District and superannuated from service on 31.12.2019, the petitioner is entitled to claim under Ward’s quota. Prior to this recruitment, the petitioner has applied for selection to the post of Grade II Women Police Constable in the process of selection in the year 2022 as an open market candidate and got selected in Page 3 of 8 https://www.mhc.tn.gov.in/judis W.P.No.3788 of 2024open market and sent for training on 01.06.2023. Subsequently, she applied to the present selection post for which she had produced ‘No Objection Certificate’ issued by the Principal of the Police Training College, Trichy dated 22.06.2023 and her selection was rejected on the ground that she was already in employment.4. Aggrieved by the same, the petitioner has come forward with the present Writ Petition.5. The learned Senior counsel appearing for the petitioner submitted that the petitioner had applied to the post of Grade II Women Police Constable only under open market and not under Ward’s quota. He further submitted that the official respondents misconceived that she got selected in the aforesaid post under Ward’s quota and rejected her selection for the subject post in issue. He contended that private respondents, who have been selected under Wards’ quota have secured lesser marks than the petitioner. Hence, he prayed to grant the relief as sought for by the petitioner in the present Writ Petition. 6. Per contra, the learned Additional Advocate General appearing on behalf of the respondents submitted that the petitioner has suppressed her Page 4 of 8 https://www.mhc.tn.gov.in/judis W.P.No.3788 of 2024employment while applying for the said recruitment which came to light during Certificate Verification at TNUSRB and hence, her category was changed from Ward’s quota to General open quota and was found ineligible and disqualified from the selection process. He further submitted that the information brochure of the said recruitment clearly states that the candidates already serving under Central /State government services are not eligible for this Wards cum Dependent quota in Sub Clause vi. He continued that since the petitioner was already employed as Gr.II Women Police Constable, she is not eligible to claim selection under Wards cum Dependent quota. Hence, he prayed this Court to dismiss the petition as the relief sought for by the petitioner is not maintainable.7. I have considered the rival submissions made by the respective learned counsels and also perused the materials available on record.8. The facts in the present case are not disputed. Admittedly, prior to the impugned notification, the petitioner participated in the selection process for Grade II (W) Police Constable and was selected in the open market category under MBC reservation and sent for training. Subsequently, she participated in the impugned recruitment for the post of Sub Inspector of Police under the Ward’s quota but as per the brochure issued by the Page 5 of 8 https://www.mhc.tn.gov.in/judis W.P.No.3788 of 2024recruitment board which clearly states the eligibility criteria for applying under 10% Wards Cum Dependent quota, wherein Sub Clause vi of para 10 specifically states about employed candidates to the effect that candidates already serving under Central / State Government services are not eligible for this Wards cum Dependent quota. Since the petitioner has already been in employment, her claim of selection under Ward’s quota is impermissible. The petitioner herein cannot question the selection of the private respondents since the petitioner herself is not eligible to the recruitment under Ward’s quota as she had already employed. Hence, the order of rejection passed by the respondents warrants no interference.9. For the foregoing reasons, the Writ Petition stands dismissed. Consequently, connected Miscellaneous Petitions are closed.
