For the sake of convenience, the petitioner in both the writ petitions is hereinafter referred to as 'management' and the private respondents in both the writ petitions are hereinafter referred to as Page No.20 of 26 https://www.mhc.tn.gov.in/judis W.P.Nos.6381 & 6382 of 2018'workmen'.3. The workmen were working under the management continuously for nearly 25 years. The management could not continue its operation and the workers were given option to opt for Voluntary Retirement Scheme (VRS) and the last date for VRS was 10.05.1998. Those who had opted VRS were given financial assistance. Some of the workers were given quarters and they were asked to vacate and handover the vacant possession. Those employees approached this Court and this Court, had directed the management to arrive at a settlement. In the meanwhile, in the Bangalore unit of the Binny Ltd., those workers who are housed in quarters were given 500 sq.ft. of land. Applying the same, the management struck a deal with those who are housed in quarters and promised them that they would be given 500 sq.ft of land. Claiming parity with those workers, the workmen herein filed petitions u/s 33(C)(2) of the I.D. Act before the II Additional Labour Court, Chennai, seeking allotment of 500 sq.ft. of land in Perambur, Chennai or in lieu thereof, Rs.15,00,000/- to each of the workmen by the management. The management filed a counter and opposed the claim on the ground that these workmen had opted for VRS and they have also been financially Page No.21 of 26 https://www.mhc.tn.gov.in/judis W.P.Nos.6381 & 6382 of 2018benefitted by the management. Oral and documentary evidence was let in by both sides and the Labour Court, on analyzing the same, came to the conclusion that the management had acted in a biased manner and directed the management to pay a sum of Rs.15,00,000/- to all the workmen. Challenging the same, the present writ petitions are filed.4. Learned counsel for the petitioner/management submitted that the Labour Court has misused the factual aspect of Section 33(C)(2) of the I.D. Act. Section 33C(2) of the I.D. Act, allows a workman to seek the computation of benefits due to them based on an existing right, arising from an award or settlement. The Labour Court's jurisdiction is limited to determining the amount due. Section 33C(2) provides a mechanism for a workman to seek the recovery of monetary and non-monetary benefits that are due to them, essentially acting as a form of execution proceedings. The Labour Court's role under this section is limited to the extent of determining if any amount of money or benefit due to the workman, but not to decide whether the workman is entitled to it in the first place. He draw the attention of this Court to an order dated 31.10.2019 passed by this Court in W.P.Nos.30818 to 30829 of 2015, wherein, similarly situated workers had challenged the rejection order of Page No.22 of 26 https://www.mhc.tn.gov.in/judis W.P.Nos.6381 & 6382 of 2018the Labour Court, wherein the similar prayer was made and this Court, dismissed those writ petitions and held as follows :-“13. On a reading of the conditions in the MOU, it is clear that the benefit of 500 sq.ft. was extended only to 244 workers, who were in occupation of the company quarters. Thus, the Labour Court arrived at a conclusion that the writ petitions had not established nay pre-existing right so as to entertain a computaion petition under Section 33-C(2) of the Industrial Dispute Act. Further, the Labour Court found that the merits on issues raised by the writ petitions in computaion petition cannot be decided under Section 33-C(2) of the Industrial Dispute Act.”5. Learned counsel for the respondent submitted that the Labour Court was fully justified in entertaining their claim. The employees had put it 24 years of unblemished service. When all the employees were retrenched, every retrenched employee should be treated equally. Further, the present employees were treated in a step montherly manner and only 244 employees were handpicked by the management and they were benefitted with 500 sq.ft. of land in a prime locality in Chennai. When all the employees were retrenched during the same time and the nature of work that they performed was also equal, they should also be treated Page No.23 of 26 https://www.mhc.tn.gov.in/judis W.P.Nos.6381 & 6382 of 2018equally. Therefore, the learned counsel, submitted that the order of the Labour Court is perfectly justified and the same needs no interference.6. This Court is of the view that the Labour Court has grossly erred in entertaining the claim petition u/s 33(C)(2) of the Act. The moment the employees accepted the voluntary retirement and availed financial assistance from the management, the relationship of the employer-employee had ceased. Merely after a decade, they come up with the present claim. The arrangement of the management with 244 workers was totally under a different scenario and those employees who were housed in quarters and they were asked to move out. Based on an arrangement arrived at the Bangalore unit of Binny limited, similar benefit was extended to the workmen herein also. Therefore, the same cannot be equatted to all the employees. Therefore, this Court is in complete agreement with the arguments raised by the learned counsel for the petitioner and orders of the Labour Court is liable to be set aside.7. In the result, these Writ Petitions are allowed and the impugned orders dated 28.04.2017 and 09.09.2016 passed by the 1st respondent are set aside. No costs.
