On such deposit, the appellant/claimant is permitted to withdraw the award amount by making formal application before the Tribunal. Cross Objection No. 73 of 2024 has been filed to set aside the Judgment and decree dated 18.03.2021 passed in MCOP 254 of 2019 on the file of MACT Special Sub Court MACT-II, Thiruvallur and remand the above CMA 929/2024.3. For the sake of conveniece the parties are denoted as per CMA No. 929 of 2024. 4. On 03.08.2017 at about 11.00 p.m., while the claimant/appellant was travelling as a pillion rider in the first respondent's vehicle which is unregistered, ridden by one Kaviyarasan, proceedinig from Thandalam to Mappedu, when they were nearing Dr.Kuppam Kuzham & Cemetry, the above said two wheeler was ridden by its driver in a rash and negligent manner in an uncontrolled speed and due to sudden crossing of dog the claimant was thrown away from the two wheeler and sustained grevious injuries. After considering the available records the tribunal awarded compensation of Rs.3,84,360/- as compensation. Challenging the quantum of compensation, the claimant filed this appeal.5. The learned counsel for the appellant submits that the claimant was working in the Packaging department in the private company but the tribunal has fixed only Rs.8,000/- as income of the claimant and also awarded very less amount in other heads. Hence, he prays to allow this appeal.6. The learned counsel for the second respondent submits that the tribunal has wrongly came to the conclusion that the driver of the insured vehicle was at negligence based on the FIR alone and there is no eye witness for the accident. Further, the tribunal has awarded very high compensation which is unsustainable and liable to be interfere. Hence, he prays to set aside the award passed by the tribunal.7. Considering the facts of the case, the claimant has proved his case based on the material evidence. Hence, the tribunal has rightly fixed liability on the second respondent. Further, the claimant was working in the packaging department and also considering the cost of living at the time of the accident, this Court is inclined to fix Rs.14,000/- as notional income of the claimant. Accordingly, the claimant is entitled to Rs.84,000/- under the head of loss of income for six months. Further, the tribunal has awarded very excessive amount under the head of loss of happiness and amenities. Accordingly, the award passed under the head of loss of happiness and amenities is reduced to Rs.40,000/- from Rs.60,000/-. Except above modification, the award passed by the tribunal in other heads remain unchanged. 9.
