For Petitioner: Mr.G.T.SubramaniamFor R1 : Mr.U.Baranidharan, 1/8 https://www.mhc.tn.gov.in/judis W.P.No.2950 of 2025 Standing CounselFor R2: Mrs.Subharanjani Ananth Standing CounselFor R3: Mr.M.T.Arunan, Standing Counsel assisted by Mr.V.Rajasurya* * * * *O R D E RThis Writ Petition is filed to direct the 1st respondent to upgrade the petitioner's PG qualification in the official portal of the first respondent. 2.The petitioner completed her M.B.B.S. course in Stanley Medical College in 2015 and registered with the Tamil Nadu Medical Council as a Medical practitioner vide Registration No.114240 and a registration certificate was issued to her on 22.12.2015. The petitioner joined the third respondent Institute for P.G. Degree in M.D. (Psychiatry) in July 2017. The petitioner completed M.D. (Psychiatry) in December 2022. After passing the said examination, the third respondent institute uploaded the petitioner's P.G. qualification with the first respondent in January 2023. Subsequently the petitioner also applied for upgradation of the P.G. Degree, but the first respondent did not upgrade the same stating that the petitioner's college did not upload the students list. As the first respondent did not upload the 2/8 https://www.mhc.tn.gov.in/judis W.P.No.2950 of 2025petitioner's P.G. qualification the petitioner filed the above writ petition for the aforesaid relief. 3.The third respondent filed a detailed counter affidavit stating interalia that the number of seats in the academic year, etc of the Institutes of National Importance (INIs) do not come under the purview of National medical Commission or the State medical Council and therefore the first respondent TNMC had to verify only the genuineness of certificates issued by the third respondent before the registration of qualification. The third respondent requested the first respondent to increase the seat matrix in P.G. (Psychiatry) from 4 to 5, vide application No.202502222-4683 along with the National Medical Commission order, but the first respondent in it's official website continued to show the recognised seat matrix for MD Psychiatry as 4 only. According to the third respondent in the year 2017, the total number of seats were increased from 4 to 5 as the unfilled seats were carried forward to the next year, thus the students intake was increased to 5 seats. Soon after issuing the course cum Conduct Certificate in January 2023, the third respondent tried to upload her P.G. upgradation, but it was rejected as “recognised seats exceeded the allocated limit”. Even when the third 3/8 https://www.mhc.tn.gov.in/judis W.P.No.2950 of 2025respondent tried on 28th February, 2025 in the Official Website of the first respondent to increase the seats vide application No.:20250222-4683, the application status reflected as, “Waiting for TNMC Online Approval”. The third respondent therefore submitted that the writ petition should be allowed with a direction as prayed for. 4.The learned counsel for the first respondent submitted that for uploading the petitioner's P.G. qualification in the portal of the respondent, the minutes of the third respondent with respect to the increase in seats need to be first uploaded. The learned counsel further submitted that if the minutes of the third respondent increasing the intake of seats from 4 to 5 for the academic year, 2017 is uploaded by the third respondent, then the first respondent would upgrade the petitioner's P.G. qualification. Both the respondents counsel prayed for sufficient time to comply with the directions, if any, to be issued by this Court. 5.I have heard both the learned counsels and I have perused the materials placed on record. 4/8 https://www.mhc.tn.gov.in/judis W.P.No.2950 of 20256.It is seen that the petitioner completed the P.G. Degree in M.D. (Psychiatry) in December 2022 and because of the dispute between the respondent Nos.1 and 3 on the recognised intake of seats, the upgradation of the petitioner's P.G. Degree has not been done, till date eventhough two years have lapsed. The third respondent in it's counter clearly stated that there was an increase in intake in M.D. (Psychiatry) seats for the year 2017 from 4 to 5 as the unfilled seat of the previous year was carried forward to the next year. Hence for the academic year 2017 the recognised student intake was 5 seats. The first respondent refused to upgrade the P.G. Degree of the petitioner on the sole ground that the recognised seats exceeded the allocated limit. The learned counsel for the first respondent submitted that as the respondents gave justification for the increase in seats for the academic session 2017, the respondent may be directed to upload their minutes of the meeting with respect to the increase in seats for the year 2017 and after the same is uploaded, the first respondent would upgrade the petitioner's P.G. Degree in it's official portal. In my view as the third respondent has validly increased the intake a direction needs to be issued to the third respondent to upload the minutes of the meeting regarding the increase of intake from 4 to 5 in M.D. 5/8 https://www.mhc.tn.gov.in/judis W.P.No.2950 of 2025(Psychiatry) in the official portal of the first respondent, so as to enable the first respondent to upgrade the P.G. qualification of the petitioner in it's portal Hence the third respondent is directed to upload the minutes of its meeting regarding the increase of intake in M.D. (Psychiatry) for the Academic session 2017, within a period of four weeks from the date of receipt of a copy of this order. As soon as the third respondent uploads the minutes as aforesaid the first respondent shall upgrade the petitioner's P.G. Degree in it's official portal, within a period of six weeks thereafter. 7.With the aforesaid direction, this Writ Petition stands disposed of.
