In pursuant to the earlier order dated 14.11.2025, an amendment has been carried out consequent to the death of the first defendant in C.S.No.852 of 2009 by recording the plaintiffs 1 to 9 as legal heirs of the deceased first __________Page 4 of 8 https://www.mhc.tn.gov.in/judis defendant. Both side counsels in both the suits also filed terms of compromise stating that the parties have compromised the issue between themselves and entered into a terms of compromise and hence, these suits have to be decreed in terms of compromise. 3. The fourth defendant in C.S.No.852 of 2009 is present before this Court. The 9th plaintiff in C.S.No.852 of 2009 who represents the plaintiff 1 to 8 as power agent is present through Video Conferencing. The first and second defendants were already set exparte. The fourth defendant in C.S.No.852 of 2009 is the plaintiff in C.S.No.677 of 2010. The second defendant in C.S.No.677 of 2010 is also present through Video Conference. The first defendant in C.S.No.677 of 2010 who is an old person also moved out of the suit property and that has been admitted by the plaintiff herself who is present today. 4. The parties who had made appearance through Video Conference have been identified by their respective counsels. Both parties agreed to the terms of compromise. The plaintiff in C.S.No.677 of 2010 has stated that she has taken possession of the suit property in pursuant to the sale deed which has been admitted by the plaintiffs and the defendants in both the suits. The terms of compromise entered into between the parties in this regard have been recorded. 5. In the result, the suits are decreed in terms of memorandum of __________Page 5 of 8 https://www.mhc.tn.gov.in/judis compromise. The terms of memorandum of compromise shall form part of this decree. No costs.
