By the impugned order, Trial Court refused the appointment of Court Commissioner under Order XXVI Rule 9 of “The Code of Civil Procedure, 1908”. It is settled law that, Court­Commissioner cannot be appointed for collecting the evidence, for the parties. In that view of the matter, I do not find error in the impugned order so as to enable me to invoke jurisdiction of this Court conferred under Article 227 of the Constitution of India. The writ petition is, accordingly, dismissed.
