#1. Heard Mr. Sunil Kamble, learned Advocate for the Applicant and Mr. Nitin Patil, learned A.P.P. for the Respondents-State.

#1. On 23rd July 2026, the following order was passed : Heard learned counsel for the Applicant and learned APP for the Respondent-State.

#2. After considering the nature of the allegations and taking into account that the Applicant has no criminal antecedents, I am of the opinion that it would be expedient in the interest of justice to direct the Applicant to join the 1 of 4 investigation. In the event of arrest of the Applicant - Abhishekh Alias Abhi Ambadas Mantri, in connection with Crime No. 131 of 2026 dated 14/04/2026 registered with Ichalkaranji Police Station, District: Kolhapur, for the offence punishable under Sections 111, 308(5), 324(4), 115(2), 351(2), 352, 189(4), 191(3), 194(2) and 192 of the Bharatiya Nyaya Sanhita, 2023 and Sections 5 and 25 of the Arms Act, 1959 and Section 135 of the Maharashtra Police Act, 1951, the Applicant be released on bail on furnishing P.R. Bond in the sum of Rs.50,000/- (Fifty Thousand Rupees Only), with one or two sureties in the like amount, on the following conditions: A) The Applicant shall attend the concerned police station on every Friday and Saturday between 11:00 a.m. to 2:00 p.m., until further orders. B) The Applicant shall not tamper the prosecution evidence. C) The Applicant shall submit his Aadhar Card and PAN Card copy to the Investigating Officer along with mobile numbers and detailed addresses of two of his near relatives.

#3. Needless to say, violation of any of the aforesaid conditions may entitle the prosecution to seek cancellation of the interim relief granted herein above.

Mr. Sunil Kamble, learned Advocate for the Applicant, states that the Applicant has appeared before the Investigating Officer and has cooperated with the investigation in Crime No. 131 of 2026, dated 14th April 2026, 2 of 4 58-ABA-371-2026 (CR).docx registered with Ichalkaranji Police Station, District Kolhapur. He submits that the Applicant shall continue to cooperate with the Investigating Officer and appear before the Investigating Officer as and when required in Crime No. 131 of 2026.

#4. Mr. N. Patil, learned A.P.P. for the Respondents-State, on instructions from the Investigating Officer, states that the Applicant has appeared before the Investigating Officer and has cooperated with the investigation in Crime No. 131 of 2026. He states that the weapon used in the crime has been recovered from the Applicant. He submits that the investigation is complete, the chargesheet has been filed, the same is registered as R.C.C. No. 304 of 2026 and is pending before the Judicial Magistrate First Class, Ichalkaranji, for committal.

#5. Mr. N. Patil, learned A.P.P. for the Respondents-State, requests for imposing an additional condition that till the framing of charge in Crime No. 131 of 2026, the Applicant shall not enter the jurisdiction of Ichalkaranji Police Station, District Kolhapur.

#7. In view of the statements made by Mr. Sunil Kamble, learned Advocate for the Applicant and Mr. N. Patil, learned A.P.P. for the Respondents-State, the order dated 23rd July 2026 is confirmed and made absolute in terms of condition Nos. 2 (i) (A), (B) and (C), subject to the following additional conditions. ADDITIONAL CONDITIONS : “(a) The Applicant shall appear before the Investigating Officer, Ichalkaranji Police Station, District Kolhapur, as and when required by the Investigating Officer in Crime No. 131 of 2026. (b) The Applicant shall not enter the territorial jurisdiction of Ichalkaranji Police Station, District Kolhapur, until the framing of the charge by the Trial Court in Crime No. 131 of 2026.
