Mr. Ritesh Kalra holding for Mr. S.K. Mishra, learned counsel appearing for respondent-Nagpur Improvement Trust makes a statement that the application moved by the petitioner under Section 44 of the Maharashtra Regional and Town Planning Act, 1966 shall be decided within a period of two weeks from the date of receipt of this order. He assures this Court that pending decision of the application the Nagpur Improvement Trust will not proceed with the notice. In view of these statements, the cause of action to proceed with the petition does not survive. However, we make it clear that in the event the order is adverse to the petitioner the same shall not be acted for the period of two weeks thereafter. 2 In view of this, the petition stands disposed of.
