Present application is preferred for challenging order passed by the Court of Sessions refusing to discharge the applicant. It is submitted that considering the nature of order passed, the applicant ought to have invoked the jurisdiction under Article 227 of the Constitution of India. Learned counsel for the applicant seeks the liberty to withdraw the present proceeding for filing appropriate proceeding. Liberty being sought at an early stage, the same deserves to be granted. Application stands disposed of as withdrawn with liberty to prefer appropriate proceeding in accordance with law. JUDGE Gulande
