DATED : NOVEMBER 8, 2011 Heard Shri Khamborkar, learned Counsel for the petitioners, and Shri Kothari, learned Assistant Government Pleader for the respondent nos. 1, 2 and 4. Civil Application No. 2713/2011 is moved by the petitioners for early hearing. Shri Khamborkar, learned Counsel for the petitioners, states that the petition was listed for final hearing before this Court on 12/7/2007. However, since Counsel for the petitioners remained absent on that date, the petition was dismissed for want of prosecution, but at later point of time, the order of 2 dismissal of petition came to be set aside and the petition was restored to file of this Court and the petition is now listed for final hearing at serial no.260. It is in these circumstances, the learned Counsel prays that the matter may be taken up for final hearing. Since the matter is already on board and the respondents have also filed return, the matter will be taken up for final hearing on 29/11/2011, if in normal course, the same is not listed for final hearing.
