Heard Shri Vora, learned counsel for the applicant- employee and Shri Verma, learned counsel for the respondent. The application is to condone delay of 107 days in filing First Appeal under Section 30 of Workmen's Compensation Act,

1923. The learned counsel for the applicant states that the applicant has suffered partial disablement to the extent of 60% and being native of Andhra Pradesh, he could not immediately arrange to file appeal. He is also not in employment. Shri Verma points out that the employee was very much present before the lower Court when the award was declared. He, therefore, states that there are no just and sufficient reasons given for condoning the delay. 2 From the perusal of application it is apparent that because of adverse circumstances pointed out above, appeal could not be filed within limitation. In any case, there are no malafides on the part of the applicant/ appellant. Hence, delay of 107 days is condoned and application is allowed.
