Leave to appeal against order of acquittal of all the respondents for commission of offences punishable under Section 4 r/w 25 of the Arms Act, Section 135 of the Bombay Police and Sections 3 (1)(ii) and 3(4) of the Maharashtra Control of Organized Crime Act and against the order of acquittal of respondent no. 3 for the offence punishable under Sections 341, 342, 323, 506 Part II r/w 34 of IPC and 376 (2) (g) of IPC is granted. Criminal Appeal No. _______/2010. Heard. Admit. 2 Action under Section 390 of Cr.P.C. to follow against respondent no.3 only. Respondent no.3 be released on bail on furnishing a PR bond in the sum of Rs.10,000/- with two sureties in the like amount and with the conditions that respondent no.3 shall not leave the jurisdiction of this Court pending hearing and disposal of this appeal, shall not commit any offence while on bail, shall not indulge in any activity of threatening, intimidating the witnesses at the trial and shall report to Ambazari Police Station, Nagpur on every Monday for first two months and thereafter on first Monday of every month between 11 and 12 noon.
