Heard Shri Bhoot, learned counsel for the applicant and Shri Mishra, learned counsel for the respondent. The delay of 853 days in filing appeal under Section 30 of Workmen's Compensation Act, 1923, is sought to be condoned. Shri Bhoot, learned counsel for the applicant contends that the application for review was filed pointing out to the Commissioner that employer has in fact admitted the accident. He states that after decision on review, the appellant could not immediately approach this Court because of his financial condition. Shri Mishra, learned counsel who appears for the respondent opposes the 2 request on the ground that there are no just and sufficient reasons given for condonation of delay. Considering the fact that the son of present applicant is alleged to have been expired in an accident, thereafter filing of proceedings under Workmen's Compensation Act and also the age of present applicant, the delay of 853 days in filing the appeal is condoned. The office is directed to register the First Appeal and to place it for further consideration immediately thereafter. JUDGE *GS.
