The issue regarding right of a secured creditor to apply second time to the District Magistrate soliciting an order u/s 14 of the SARFAESI Act after it looses possession of the secured assets, allegedly forcibly or illegally by the debtors. The petitioner / financial institution has moved such second applications soliciting orders of the District Magistrate u/s 14 of the SARFAESI Act and obviously seeking its execution so as to enable it to recover back the secured assets. 5. The issue was dealt with by a co-ordinate division bench of khs/Dec.2024/13691 - 6 - this Court in the matter of the Nashik Merchant Co-operative Bank Vs. the District Collector, Jalna and others, WP No.10069/2022, decided on 28.02.2023. It was rendered by referring to the judgment in the matter of M/s Sri Balaji Centrifugal Castings Vs. M/s ICICI Bank Limited, (2018) SCC Online, Hyd 368 and A.A.Kumaran Vs. Superintendent of Police, Thissur and others in WP © No.5875 of 2022 dated 18.05.2022. 6. In the petitioner’s earlier matters referred to hereinabove, again the issue had cropped up and this Court had directed the District Magistrate to decide its second applications preferred u/ 14 of the SARFAESI Act. 7. It is even pointed out that the case in the matter of Sri.Balaji Centrifugal (supra) had reached the Supreme Court, which refused to entertain the SLP. 8. For the sake of convenience, the learned Advocate for the petitioner has tendered across the bar a chart indicating as to when the possession was recovered earlier and when the second application has been moved before the District Magistrate. In the light of the above, there is no escape from following the same course. The writ petitions are allowed.
