PEDNEKER, J.Dated : November 26, 2024.PER COURT :-1.Heard learned counsel for the applicants and the learned APP forthe respondent-State. 2.The applicants are seeking bail as they were arrested inconnection with FIR No.0579/2024, dated 20/09/2024, registered withNandurbar Police Station, Nandurbar, for the offences punishable undersections 109, 132, 121(2), 324(4), 324(5), 118(1), 189(2), 191(2),191(3), 326(F), 326(G), 125(A), 125(B), 333, 298 and 190 of BhartiyaNyaya Sanhita, 2023, under Section 4 and 25 of Arms Act, underSection 3, 7 of Prevention of Damage to Public Property Act, underSection 3 of Criminal Law (Amendment) Act, 2013, and under Section37(1), 37(3) and 135 of Maharashtra Police Act, 1951. 3.The learned counsel for the applicant relies upon the order passedin Bail Application No. 1905/2024 (Lalitkumar Kamalakar Baviskar vs.The State of Maharashtra), dated 24/10/2024. The learned counsel forthe applicant submits that the case against the applicant is identical toPage 7 of 9 905 BA 1964-2024the case of Lalitkumar (supra). The learned APP has not been able tocontrovert the factual assertions as contended by the applicant.4.In view of the above, the applications are allowed in the followingterms : -a]The applicants shall be released on bail in connection withFIR No.0579/2024, dated 20/09/2024, registered with NandurbarPolice Station, Nandurbar, for the offences punishable undersections 109, 132, 121(2), 324(4), 324(5), 118(1), 189(2), 191(2),191(3), 326(F), 326(G), 125(A), 125(B), 333, 298 and 190 ofBhartiya Nyaya Sanhita, 2023, under Section 4 and 25 of ArmsAct, under Section 3, 7 of Prevention of Damage to Public PropertyAct, under Section 3 of Criminal Law (Amendment) Act, 2013, andunder Section 37(1), 37(3) and 135 of Maharashtra Police Act,1951, on furnishing PR bond of Rs.20,000/- with one or twosureties in the like amount to the satisfaction of the trial Court. b]The applicants, upon being released on bail, shall notcontact the informant, in any manner whatsoever, during thependency of the trial. c]The applicants shall co-operate with the trial Court and heshall attend each and every date, unless exempted by the trialCourt, for reasons to be recorded in writing.d]The applicants shall not tamper with the evidence of thePage 8 of 9 905 BA 1964-2024prosecution and he shall not influence the informant, witnessesand other persons concerned with the case. e]The applicants, upon being released on bail, shall place onrecord of the trial Court the details of his Contact Number andresidential address with updates in case of any change. 5.Needless to say, in case of violation of any of the aforesaidconditions, the bail granted to the applicant shall be liable to becancelled. It is also clarified that the observations made in this order arelimited to the disposal of the present bail application. The concernedCourt shall proceed further in the matter without being influenced bythe observations made hereinabove. 6.The applications stand disposed of.( ARUN R.
