The applicant, one of the accused in Crime No.244/2010 registered by Shirpur Police Station, District Dhule for offence punishable under Sections 302, 323, 504 read with section 34 of the Indian Penal Code seeks her release on bail.

As per the prosecution case on 16.8.2010 the present applicant is alleged to have wielded a stick and is also alleged to have caused injury to deceased Vinod. As per the allegations Bhimrao, husband of the applicant had kicked on his genitals, which ultimately resulted in his death. The present applicant had used stick but the post mortem report does not reveal that any serious injury had been caused by the applicant by using the stick. In such circumstances and taking into consideration 2 that the applicant is a lady said to be aged 55 years, I am inclined to allow this application.

Accordingly, this application is allowed and the applicant is directed to be released on bail on applicant executing a P.R. bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the trial Court.
