The present applicants, who are arrested in Forest Crime No. 2/2012, for the offence punishable u/s. 41, 42, 52(1) of the Indian Forest Act 1927 and Rule 66 of The Mumbai Forest Rules, 1942, are praying for their release on bail. 2

The allegations are that the applicants were found with 70 pieces of teak wood admeasuring 0.798 cubic meters. They were arrested on 25/08/2012.

The learned counsel for the applicants submits that the applicants are only driver and cleaner of the vehicle from where 70 pieces of teakwood were seized while main accused Rashid fled away and absconding. The investigation is complete, therefore the applicants may be released on bail.

Learned A.P.P. opposed the application.

Considering that the investigation as regards to present applicants is complete, they can be released on bail. Hence order - Applicants Sk.Nazim Sk.Mohmad and Syad Ismail Sayad Ahmad be released on bail, on their execution of P.R.bond in the amount of Rs.20,000/- each and also upon furnishing surety in the like amount by each of them.
