PEDNEKAR, J.DATE: 28-07-2025PER COURT:-1.Heard the learned counsel for the applicant and the learnedA.P.P. for the respondent.2.The applicant is seeking bail as he is arrested on 15.05.2025in connection with Crime No.203/2025, registered with City PoliceStation, Jalgaon, for the offences punishable under Sections 3, 25and 27 of the Arms Act and Section 109 of the Bhartiya NyayaSanhita, 2023. 3.The learned counsel for the applicant submits thatInvestigation Officer has withdrawn section 109 of B.N.S. againstthe applicant and only offence under Section 3/25 and 3/27 ofArms Act is registered against the present applicant. The applicantis behind bar since 15.05.2025. 2 18-BA-1280-25.odt4.The learned APP submits that the applicant is involved in thealleged crime, as such, bail should not be granted in favour of theapplicant.5.Since offence is bailable and applicant is behind bar since15.05.2025, the applicant is granted bail. The application isallowed in the following terms :a]The applicant shall be released on bail in connection withCrime No.203/2025, registered with City Police Station, Jalgaon, for the offences punishable under Sections 3, 25and 27 of the Arms Act and Section 109 of the BhartiyaNyaya Sanhita, 2023, on furnishing PR bond of Rs.20,000/-,with one or two sureties in the like amount to thesatisfaction of the trial Court. b]The applicant, upon being released on bail, shall notcontact the informant, in any manner whatsoever, duringthe pendency of the trial. c]The applicant shall co-operate with the trial Court and heshall attend each and every date, unless exempted by thetrial Court.d]The applicant shall not tamper with the evidence of theprosecution and he shall not influence the informant, witnesses and other persons concerned with the case. e]The applicant, upon being released on bail, shall place onrecord of the trial Court the details of his Contact Numberand residential address with updates in case of anychange. 3 18-BA-1280-25.odt6.Needless to say, in case of violation of any of the aforesaidconditions, the bail granted to the applicant shall be liable to becancelled. It is also clarified that the observations made in thisorder are limited to the disposal of the present bail application.
