In all aforesaid Land Acquisition References,agricultural lands owned and possessed by claimants,situated at village Tambewadi, Taluka – Paranda, District –Osmanabad, are acquired by the State Government forconstruction of Tambewadi Medium Project, undernotification under section 4 of the Land Acquisition Act,published in Government Gazette on 5th July, 1990.4.In Land Acquisition Reference at Serial No. 1, in theabove chart, the Reference Court has awardedcompensation @ Rs.40,000/- per Acre and in the remainingreferences, from serial No.2 to 10 @ Rs.41,481/- per Acre is 10 1137-17-FA.odtawarded, treating the said lands as irrigated lands.5.In Land Acquisition Reference at Serial No. 11 to 14the Reference Court has awarded compensation @Rs.37,500/- per Acre, treating the lands as Jirayat lands.6.Indisputably, present first appeals are covered by thedecisions of this Court dated 26th April, 2017 in First AppealNo. 779 of 2011 and connected maters and in First AppealNo. 993 of 2011 and connected matters, arising out of thesame acquisition and from the same village.7.This Court, by assigning reasons, grantedcompensation at the enhanced rate of Rs.72,000/- per Acrefor irrigated lands and Rs.52,000/- per Acre for Jirayat Lands,appellant-claimants are entitled for the same compensation.8.For the reasons stated in the orders dated 26th April,2017 passed in First Appeal No. 779 of 2011 and connectedmaters and in First Appeal No. 993 of 2011 and connectedmatters, first appeals are partly allowed as follows:ORDERA.First Appeals are partly allowed with proportionatecosts. B.Judgment and Award passed by Reference Court in 11 1137-17-FA.odtLand Acquisition References No.523 of 1994, 72 of1995, 69 of 1995, 70 of 1995, 67 of 1995, 73 of 1995,66 of 1995, 74 of 1994, 71 of 1994 and 76 of 1995are hereby modified in the manner that the claimantsare entitled for the compensation for the acquiredlands at the enhanced rate of Rs.72,000/- (RupeesSeventy Two Thousand) per acre with all statutorybenefits as awarded by the Reference Court. B.Judgments and Awards passed by the Land ReferenceCourt in Land Acquisition References No. 277 of 2004,605 of 2000, 149 of 2000 and 147 of 2000 are herebymodified in the manner that the claimants are entitledfor compensation at the enhanced rate of Rs.52,000/-(Rupees Fifty Two Thousand) per Acre with all statutorybenefits as awarded by the Reference Court. C.In view of order passed by this Court and in view ofundertaking furnished by the claimants before thisCourt, the claimants are not entitled for the interest forthe delayed period.D.Award be drawn up as per the above modifications.E.In view of disposal of first appeals, pending civilapplication, if any, also stand disposed of. 12 1137-17-FA.odtF.Claimants shall pay the deficit court fees within fourweeks from today.
