We are informed that pursuant to the order dated 13.10.2021, the concerned authority has heard the learned counsel for the respective sides and the matter is closed for orders. The grievance of the review petitioner/ NHAI is that the competent authority is functus officio. 3. Since the arguments have already been advanced and the matters are closed for orders and since the review petitioner has taken a stand that the competent authority is functus officio, we have no doubt that the competent authority would consider all contentions of the parties including as to whether, it is functus officio or not and accordingly, deliver it’s order. It would be appropriate for us to observe that the copy of this order shall be placed by the litigating parties before the competent authority since the matter has now been closed for orders. 4.
