Judgment

Mr. V.S.Paradkar i/b. K.D.Juvekar for the petitioner. Mr. Ryan D’Souza i/b. A.S. Rai for Respondent No.1. Mr. Jose George for Respondents Nos. 2 to 6. CORAM CORAM: S.K.SHAH,J. S.K.SHAH,J. CORAM S.K.SHAH,J. DATE DATE : 21st April,2006. 21st April,2006. DATE 21st April,2006. P.C.P.C. P.C.

1.

I have heard Counsel on both sides. It appears that the occupents of the Buildings "K" & "L" seem to be totally uncooperative. The Respondent No.1 has in compliance with the order taken steps towards the formation of the society, but the occupants of these two Buildings are totally unco-operative. On the last occasion, the Resondent no.1 was directed to give form to the petitioner so that all the members could sign them and the application for registration could be submitted to the concerned authority. However, only three occupants have signed and other occupants of the buildings have not signed them. This shows the total non-cooperative attitude taken by the occupants of the two buildingd. In fact, the Respondent No.1 has taken steps. I do not find any merit in the Contempt Petition.

2.

The learned Counsel for the petitioner however subnmits that they will take the responsibility of getting the requisite form filled up by all the occupants of the two Buildings and give that Form to the Respondent No.1.

3.

The learned Counsel for the Respondent No.1 submits that on receipt of such Application duly completed, he will take steps for submitting the same to the Registrar of Co-operative Societies for getting the Society registered. He also further states that he needs the co-operation from all the occupants of the two Buildings. It is expected that the petitiioner would extend all the co-operation to the Respondent No.1 for getting the Society registered. In view of this, the Contempt Petition stands disposed of. --- (S.K.SHAH,J.) (S.K.SHAH,J.)
