By way of this notice of motion, it is prayed that period of 60 days in filing the notice of motion may be condoned. This motion is filed for setting aside the order by which the matter was dismissed for default. The order to that effect was passed on 28-11-2007.

Heard the learned counsel for the respondent. The learned counsel for the appellant is not present. However, the representative of the Food Corporation of India, is present. Considering the ground mentioned in the affidavit in support, the notice is allowed and disposed of by condoning the delay in filing the above motion as well as by 2 NMA 454 of 2008 restoring the appeal No.1140 of 2003 to the record of the case. Notice of motion is made absolute in terms of prayer clauses (a) and (b).

Appeal now may be list for final hearing on 21-09-2010 along with Appeal Nos.1138 of 2003, 1139 of 2003 and 1140 of 2003. ( ANOOP V. MOHTA, J. )
