An agreement was entered into between the Applicant and the Respondent on 5 May 2009. The Respondent terminated the agreement by a letter dated 10 August 2009. The Applicant, by a letter dated 30 September 2009 invoked the arbitration clause. There was no reply to the notice invoking arbitration. Clause 7.2 of the agreement provides that all disputes between the parties arising out of or in connection with the agreement or concerning its formation, performance, interpretation, breach or termination which cannot be settled amicably shall be finally settled in accordance with PNP 2 ARBAP27-10=3.9 the Arbitration and Conciliation Act 1996. Evidently disputes and differences have arising between the parties which have not been settled amicably. There is an arbitration agreement and the provision for arbitration has been duly invoked on 30 September 2009.
Operative part
In these circumstances, the Arbitration Application is disposed of by appointing Mr. S.R. Shah, Former Judge of the City Civil Court as arbitrator under the provisions of the Arbitration and Conciliation Act,
1996. The Respondent will be at liberty to raise a counter claim, if any. (Dr. D.Y.Chandrachud, J.)
