#1. Not on board. Upon mentioning taken on board. By consent heard counsel for the parties forthwith.
#2. The petitioner is permitted to deposit a sum of Rs.3.00 lakh instead of furnishing bank guarantee for the like amount as was ordered in terms of paragraph 4 of the order dated 11th January 2008. The said order is further modified to the extent that the amount so deposited by the petitioner be invested in appropriate fixed deposit scheme to earn best interest returns, in ((-2-)) MST any nationalised bank to be kept alive till disposal of the petition. It is further ordered that in the event the respondent succeeds in the present petition, will be entitled to withdraw such amount as may be ordered by this Court including interest to be awarded to the respondent on the outstanding amount in addition to such further amount to be paid by the petitioner as per order to be passed by the Court. Undertaking be filed within one week. Motion disposed off on the above terms. . Rest of the order dated 11th January, 2008 to remain as it is. Ordered accordingly. (A.M.KHANWILKAR, J.)
