Heard Mr.Mendadkar for the Petitioners. Mr.Mane, A.G.P. appears for Respondents Nos.1 to 3.
Both the Petitioners are admitted to the Respondent No.4 Engineering College. They are admitted on reserved seats. They had applied for verification of their caste claim well in time, but unfortunately their claim has not been scrutinised as yet. In the - 2 - meanwhile, the Respondent No.4 College in each of the two cases has admitted the Petitioners to the course. We are of the view that the Petitioners’ caste claim ought to be scrutinised and before that the course which the petitioners have taken should not be disturbed. Mr.Mane states that within about 3 months, the caste claim of the petitioners will be scrutinised.
In the circumstances, we direct the Respondent No.2 Committee to scrutinise the caste claim of the Petitioners at the earliest and, in any case, by end of April 2005. The Petitioners’ admission in the Respondent No.4 College will not be cancelled in the meanwhile and for a period of 2 weeks after the decision is communicated to the Petitioners in the event the same is adverse to the Petitioners.
