By this Writ Petition, the petitioner is challenging the order passed by the learned Magistrate issuing process. As the order of the Magistrate can be challenged in the Sessions Court, the learned Counsel for the petitioner seeks liberty to withdraw the Petitiion and file it in the Sessions Court.
