P.C. 1 The application for restoration is moved with prayer that order dated 29.8.2012 dismissing the appeal for default be recalled. 2 The learned counsel for the respondents submits to the order of the Court. However, he points out that this is the third time, the appeal is dismissed for want of prosecution. The learned counsel for the applicants submits that appeal is admitted and pending since 1991. ms.s.k.talekar - 2 - 3 As the appeal is already admitted and old one, it is restored. However, the appeal to be listed on the final hearing board in the week commencing from 19th November 2012. 4 The learned counsel for the respondents submitted that he has appeared in the second appeal and he undertakes to file vakalatnama in this application.
