Heard Ms.Rao, learned counsel for the applicant and Mr.Saste, learned APP, for the State.
The applicant has prayed for bail in C.R.No.I-243/05 of Ambernath Police Station, Dist- Thane. The said crime has been registered against the applicant and eight others for having allegedly committed an offence punishable under sections 326,341, 147,148 and 149 of IPC.
It is the prosecution case that all the accused, on 4.8.2005 at mid-night, assaulted the complainant and caused serious injuries. Insofar as the applicant is concerned, according to the complainant, he along with the other accused assaulted him with fist and kick blows. Only one accused, namely, Ganesh Kadgul assaulted the complainant with sword. Considering the nature of allegations against the applicant, I am inclined to enlarge the applicant on bail. Hence, the following order. . The applicant to be released on bail in the sum of Rs.20,000/- with one or two sureties in the like amount, subject to condition that he shall report to the concerned police station every alternate Saturday between 7 and 8 pm till conclusion of the trial. . While passing this order I shall not be understood to have expressed any opinion on merits of the case and the trial Court shall deal with the case without being influenced by the observations made in this order.
