Heard both sides.
By judgment and order dated 27.7.2001, the applicant has been convicted under Sections 304-A, 279 of IPC and under Section 184 of the Motor Vehicles Act. The applicant is now seeking bail.
The learned advocate for the applicant states that the applicant was on bail pending trial. He has not misused the liberty granted to him. This statement is not controverted by the prosecution. The learned advocate for the applicant further [-2-] states that the maximum sentence of imprisonment imposed on the applicant is six months and the revision is not likely to be heard within the said period. Looking to the facts of this case and the above facts, I am inclined to grant bail.
The applicant-Prabhakar Laxman Gade be released on bail in the sum of Rs.15,000/- (Rs.fifteen thousand only) with one or two sureties to make up the said amount. The applicant to report to Malegaon Police Station, Dist. Nasik once in a month till disposal of the revision application.
