The School Tribunal has condoned the delay of two years and one month in filing an appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act,

1977. The contention of the Applicant in the application for condonation of delay was to the effect that he had been assured by the management that he would be taken back. This was not specifically denied in the reply filed by the management. That apart, it would also appear that the Deputy Director of Education had issued certain directions on 20th March 2001 to the management. In this 2 background, the case of the employee was that he was following up the matter for enforcement of the direction of the Deputy Director of Education and certain assurances were held out to him. The Tribunal has taken a plausible view to the effect that the delay was sufficiently explained. Consequently, exercise of the jurisdiction under Article 226 of the Constitution of India is not warranted. The petition is accordingly dismissed. ......
