The applicant has prayed that the amount shown in the minutes dated 18/07/2006, be amended from Rs.240.45 lacs to Rs.4,99,25,464/-. Shri Milind Bhavsar, Chief Officer, (Agro Industries Department) of the Maharashtra State Cooperative Bank Ltd., has filed an affidavit in this Court on behalf of the petitioner. On behalf of the petitioner, he has undertaken to this Court to bring back the amount of Rs.2,46,53,321/- if ordered by this Court. This undertaking is accepted. In view of this undertaking, it is not necessary to pass any separate order because, in our opinion, this undertaking sufficiently protects the applicant.

Civil Application No. 221/2006 is disposed of. Civil Application No. 222/2006 is disposed of as not pressed. (SMT. RANJANA DESAI, J.)
