Judgment
Shrikant @ Babu Mohan Sakhalkar. ..Applicant. Versus Versus Versus The State of Maharashtra ...Respondent. .... Mr.Shekhar A. Ingawale, Adv. for Applicant. Mr.V.B.Konde-Deshmukh, APP, for State. .... CORAM : SMT.V.K.TAHILRAMANI,J. CORAM : SMT.V.K.TAHILRAMANI,J. CORAM : SMT.V.K.TAHILRAMANI,J. DATED : 7th July, 2008. DATED : 7th July, 2008. DATED : 7th July, 2008. P.C.:
Heard the learned Advocate for the Applicant and the learned APP for the State.
The applicant is seeking bail in C.R.No.84 of 2007 of Shivaji Nagar police station, Ichalkaranji. The said case is mainly under Section 489(A)(B)(C) of IPC.
The learned Advocate for the applicant submitted that coaccused Balkrishna Vastare, who has been found in possession of counterfeit like the present applicant, has been released on bail, hence, the present applicant may be released on bail on the ground of parity. ..(2)..
The learned APP submitted that in addition thereto printer and scanner came to be seized at the instance of the applicant. As far as this aspect is concerned, the learned APP before the trial Court has fairly stated that there is no material to show that the printer and scanners were used to make counterfeit currency notes. Looking to all these aspects, I am inclined to grant bail.
The applicant - Shrikant @ Babu Mohan Sakhalkar to be released on bail in the sum of Rs.35,000/- with one or two sureties to make up the said amount. The applicant shall report to Shivaji Nagar police station, Ichalkaranji twice in a week for six months and thereafter once in a week, till conclusion of the trial.
