DATE : JULY 10, 2009 P.C.: 1 Perused the application received through jail. Heard the learned A.P.P. The case made out in the application is that the applicant is in custody from 13th August 2007 and the case under Narcotic Drugs and Psychotropic Substances Act, 1985 is not proceeding and therefore, prayer is for directing the expeditious disposal of the trial. 2 It is true that as the applicant is in jail, priority has to be given to the trial. However, there may be older cases pending before the concerned court where the accused are in custody for a longer time. Though the case of the applicant deserves to be heard expeditiously, the cases of the accused in jail will have to be taken up chronologically in as much as older cases in which accused are in jail for a longer time will have to be given priority. 3 Subject to what is observed above, the learned Judge will endeavour to conclude the trial expeditiously. A copy of this order be forwarded to the applicant who is in jail. s JUDGE
