Judgment
Mr.S.S.Patwardhan Mr.S.D.Rayrikar, A.G.P. for respondent No.1. petitioner CORAM : DATE : S.C.DHARMADHIKARI S.S.SHINDE, JJ. 27th May 2008 P.C. . This petition under Article 226 of the Constitution of India seeks writ of mandamus or any other writ, order or direction in that nature directing respondent No.1 to hear and decide the objections which have been raised by the petitioner to the Voters’ list for the election to the Managing Committee of respondent No.2 society. 2
The matter was placed today and in the morning session, learned A.G.P. took time to seek instructions. He was orally directed to take instructions as to whether the objections which have been raised in writing by application dated 14th May 2008 have been decided and disposed of or are still pending.
Learned A.G.P. after taking instructions makes a statement before us in the afternoon session that the first respondent has already passed an order on these objections on 26th May 2008 and the said order will be duly communicated to the parties.
In the light of this statement made by learned A.G.P. on instructions, nothing survives in the petition and the same is disposed of. 3 (S.S.Shinde, J) (S.C.Dharmadhikari, J)
