Judgment

3.8.2005. By this petition the petitioner has made the following prayers: “ (a) That this Hon'ble Court be pleased issue a Writ Mandamus or Order or Direction in the nature of Writ of Mandamus or any other appropriate Order or direction directing Respondents to 1 take appropriate steps for proper investigation in Economic Offences Wing, D.C.B., CID, M.E.C.R.No.13 of 2004 registered for the offence punishable under section 120B, 420, 406, 465, 467, 468, 471 of IPC. (b) That this Hon'ble Court be pleased issue a Writ Mandamus or Order or Direction in the nature of Writ of Mandamus or any other appropriate Order or direction directing Respondents to take appropriate steps for effecting the arrest of the available Accused and to take appropriate steps for attachment of property of the absconding Accused in Economic Offences Wing D.C.B., CID, M.E.C.R.No.13 of 2004. (c) That this Hon'ble Court be pleased issue a Writ Mandamus or Order or Direction in the nature of Writ of Mandamus or any other appropriate Order or direction directing Respondents to take appropriate steps for initiating extradition proceedings against the Accused who are staying abroad. (d) For such other and further 2 reliefs as the nature and circumstances the case requires.”
#2. Affidavit in reply has been filed by the State mentioning in detail extradition proceedings are going one. When the matter came up for arguments today it was also pointed out on behalf of the State that adequate steps are being taken to seek extradition of absconding accused as early as possible. As of today there is no reason to doubt correctness of this statement. This petition can be conveniently disposed of at this stage by directing the police to continue their efforts to get extradition proceedings completed as early as possible. Order accordingly.
