This Civil Application is taken out in the Second Appeal for stay of operation of the impugned judgment. The application is opposed by the respondents.

By the order dated 11th December, * 2 * 2008 the ad-interim order on the Civil Application was passed directing that during the pendency of the application, partition proceedings shall go on. However, actual possession may not be handed over and in case the possession is already handed over, the same shall not be disturbed.
