The petitioner is the 1st Respondent in the appeal preferred by 1st to 3rd Respondents before the Sub Divisional Officer under Section 74 of the Bombay Tenancy & Agricultural Lands Act, 1948. Pending the said appeal, by the impugned order dated 4th December, 2008, the learned Sub Divisional Officer stayed the operation of the order passed by the Agricultural Lands Tribunal in exercise of powers under Section 32-G of the Bombay Tenancy & Agricultural Lands Act, 1948. 2 The learned counsel appearing for the petitioner 2 WP-2342.sxw submitted that the order impugned in the aforesaid Appeal has been already implemented . If that is so, the petitioner will not be affected by the impugned order of stay. In any event, no case is made out to interfere with the discretionary order of stay granted by the Sub Divisional Officer pending the hearing and final disposal of the substantial appeal. 3 However, hearing of the appeal deserves to be expedited. Hence, writ petition is rejected. However, it is directed that Sub Divisional officer will decide the pending appeal within a period of six months from today. JUDGE
