Heard Mr.Pawar, the learned counsel for the applicant and Mr.Shinde, the learned APP for the State.
The applicant was convicted for the offences punishable under Sections 7 and 13(1)(d) read with 13(2) of the Prevention of Corruption Act and was awarded imprisonment for six months and fine of Rs.500/- on the first count and imprisonment of one year and fine of Rs.1,000/- on the second count. The applicant has preferred appeal against the conviction and sentence. Appeal is admitted. By this application, the applicant seeks to be released on bail pending the appeal.
The applicant was on bail during the trial and after conviction also, the learned Special Judge has : 2 : suspended the sentence under Section 389 of the Cr.P.C. Taking into consideration the short sentence, the applicant is granted bail on same terms and conditions as before the Trial Court subject to his furnishing fresh bail bonds and depositing the fine amount.
