IN THE HIGH COURT OF JUDICATURE AT BOMBAY APPELLATE SIDE WRIT PETITION NO.1496 OF 2008 Balasaheb V. Kshirsagar & Ors. Vs. The Balarpur Industries Ltd. & Ors. .... Mr.S. M. Oak for the Petitioner. Mr.Nitin A. Kulkarni for Respondent No.2. Mrs. M.P. Thakur, AGP for Respondent No.3. ..... ...Petitioners. ...Respondents. CORAM :DR.D.Y.CHANDRACHUD, J. April 30, 2008. P.C.: The requirement under Section 28(1-A) of the Trade Unions Act, 1926 is that a person must be a member of a Registered Trade Union for a period of not less than six months. The Petitioners submitted an application, on 11th January 2008. The Deputy Registrar of Trade Unions declined to grant his permission on the ground that no material has been produced by the applicant- Petitioners, for example, membership receipts for the immediate preceding period of six months. The reasoning of the Deputy Registrar cannot be faulted. Even before this Court the receipts 2 produced are of July 2006 which relate to the Calendar Year 2006. Hence, before this Court as well nothing is forthcoming to show that the Petitioners were members during the Calendar Year 2007 or that they have paid membership subscriptions. There is no merit in the petition. The Petition is accordingly dismissed. ......
