Heard the learned Advocate for the Applicant-orig.accused No.1 and the learned APP for the State.
The applicant has been convicted under the Prevention of Corruption Act and under Section 409 of IPC. The maximum sentence imposed on the applicant is two and half years. The applicant is now seeking bail.
The learned Advocate for the applicant has ..(2).. submitted that the applicant was on bail during the trial and he has not misused the liberty granted to him. This statement is not controverted by the prosecution. The learned Advocate for the applicant has further submitted that the sentence of imprisonment is only two and half years and the appeal is not likely to be heard within such time. Hence, he has prayed that the applicant may be released on bail.
Looking to all these facts and evidence, I am inclined to release the applicant on bail.
The applicant to be released on bail in the sum of Rs.25,000/- with one or two sureties to make up the said amount.
